Terms of Service

1. Acceptance of Terms

By installing or using Store Analytics by Audiosdroid (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not install or use the App.

2. Description of Service

The App provides analytics, reporting, and insights for Shopify stores. Features include dashboards, export capabilities, and automated email reports. The App operates as a Shopify embedded app within the Shopify admin.

3. Your Responsibilities

• You must have the authority to install the App on your Shopify store
• You are responsible for maintaining the security of your Shopify account
• You must comply with Shopify's Terms of Service and applicable laws
• You must not attempt to reverse engineer, decompile, or misuse the App

4. Subscription and Billing

The App offers multiple pricing tiers (Free, Starter, Pro, Enterprise). Paid subscriptions are billed through Shopify's billing system. You can cancel your subscription at any time through your Shopify admin. Refunds are handled according to Shopify's policies.

5. Data and Privacy

The App accesses your store data as described in our Privacy Policy. We process data solely to provide the App's functionality. We do not sell your data to third parties.

6. Acceptable Use and Restrictions

You may not use the App to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or conduct security attacks
• Access or use the App in an unauthorized manner

You are explicitly prohibited from:

• Reverse engineering: Decompiling, disassembling, or attempting to derive source code from the App
• Unauthorized access: Attempting to access restricted areas, bypass security measures, or exceed authorized usage limits
• Account sharing: Sharing your Shopify admin credentials or allowing unauthorized access to your App installation
• Data misuse: Using analytics data for purposes other than managing your own store
• Reselling: Reselling, sublicensing, or redistributing the App or its features without written permission
• Competitive use: Using the App to build competing products or services
• Automated abuse: Using bots, scripts, or automated tools to abuse the App's API or features
• Resource abuse: Deliberately overloading the App's infrastructure or attempting denial-of-service attacks

Violation of these restrictions may result in immediate suspension or termination of your access without refund, and may be reported to Shopify and relevant authorities.

7. Availability and Support

The App is provided on an "as available" basis. We do not guarantee uninterrupted, timely, or error-free access. Maintenance may occur without prior notice. Support is provided via email at admin@audiosdroid.com on a reasonable-effort basis.

8. Intellectual Property

All rights, title, and interest in the App, including all intellectual property rights, remain with Audiosdroid. You receive a limited, non-exclusive, non-transferable license to use the App during your subscription.

9. Data Accuracy and Business Decisions

IMPORTANT DISCLAIMER:

• No Guarantee of Accuracy: We do not guarantee the accuracy, completeness, or reliability of any data, metrics, or insights provided by the App. Analytics data may contain errors, omissions, or discrepancies.
• Verify with Other Sources: You should always verify important metrics and data with other sources, including Shopify's native analytics, your accounting software, and other business tools before making critical business decisions.
• Not Financial or Business Advice: The App provides data visualization and analytics tools only. It does not provide financial, tax, legal, or business advice. Consult qualified professionals for business decisions.
• No Liability for Business Decisions: Audiosdroid is not responsible for any business decisions, financial losses, revenue losses, missed opportunities, or other consequences resulting from your use of or reliance on the App's data or recommendations.
• Third-Party Data Sources: The App relies on data from Shopify's API and other sources. We are not responsible for errors or delays in third-party data.
• Beta Features: Features marked as "beta" or "experimental" are provided for testing purposes and may contain errors or produce unreliable results.

By using the App, you acknowledge that you understand these limitations and agree to verify all critical data independently.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUDIOSDROID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This includes but is not limited to:

• Revenue losses or missed sales opportunities due to incorrect analytics data
• Business decisions made based on App data or recommendations
• Inventory management errors or stockouts
• Pricing decisions based on App suggestions
• Marketing spend or attribution inaccuracies
• Tax reporting or accounting discrepancies
• Customer data analysis errors

11. Warranties Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We specifically disclaim all warranties regarding:

• Data accuracy, completeness, or timeliness
• Analytics calculations, formulas, or methodologies
• Compatibility with your specific business model or needs
• Availability or uptime of the service
• Security of your data or prevention of unauthorized access
• Results, sales, profits, or other outcomes from using the App

12. Indemnification

You agree to indemnify and hold Audiosdroid harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any applicable laws.

13. Modifications to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. If you do not agree to changes, you must uninstall the App.

14. Termination

Either party may terminate this agreement at any time. You can uninstall the App from your Shopify admin. We may suspend or terminate access immediately for violations of these Terms, without notice or refund.

15. Governing Law

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be resolved in the courts of Estonia. As an EU-based company, we comply with applicable EU regulations including GDPR.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Audiosdroid regarding the App.
